The website located at https://www.digitory.com and any associated mobile applications made available on Android and iOS (together, the “Platform”) are owned and operated by Digitory Networks Private Limited (“Company”, “we”, “our”, or “us”).
The Platform acts as a technology marketplace that curates event partners, organisers, creators, and businesses (“Partners”) who offer unique, bookable experiences, listings, or event-related services (“Experiences”). The Platform enables users (“Users”, “you”) to explore, save, book, and share such Experiences.
Digitory Solutions pvt ltd is only a technology intermediary enabling the listing, discovery, and booking of Experiences. The Company does not own, operate, manage, or control any Experience. All fulfilment, compliance, and delivery responsibilities rest solely with the Partners.
By accessing or using the Platform, you agree to these Terms & Conditions and our Privacy Policy, available via the Platform, which together constitute the “Terms”. The Company reserves the right to update or modify these Terms at any time. Continued use of the Platform constitutes acceptance of the modified Terms.
1. Interpretation
Terms in singular include plural and vice-versa. Headings are for convenience only. Words such as “including” or “for example” are illustrative, not limiting.
2. Eligibility
Only natural persons above 18 years of age (or the legal age of majority applicable to them) may register on the Platform. By registering or using the Platform, you confirm that you are legally competent to contract and not prohibited from using the services offered.
3. Registration and Services
1. Users may browse certain information on the Platform without registering.
2. To save Experiences, book an Experience, or share feedback, Users must create an account using personal information such as name, age, phone number, email ID, and related details. Users may also register via third-party accounts (e.g., Google, Facebook).
3. Registration is personal and non-transferable. Sharing login credentials is prohibited and may result in immediate suspension or termination.
4. Users are responsible for safeguarding their account credentials. Any unauthorized use must be reported immediately to support@digitory.com.
4. Booking and Payments
1. When you book an Experience, you agree to pay the applicable Booking Fee, which includes Experience charges, platform fees, taxes, and any additional charges displayed during checkout.
2. You must provide accurate payment details. By submitting payment information, you authorize the Company and its payment partners to process the Booking Fee.
3. If payment authorization fails, the Company may suspend or cancel your Booking.
4. Each Experience is subject to its respective Partner’s cancellation policy, clearly displayed on the Platform.
5. Pricing errors are not binding. If an incorrect fee is displayed, you may cancel the booking or pay the corrected amount.
6. You must not share sensitive financial information (card numbers, PINs, OTPs, passwords) with anyone. The Company is not responsible for any loss caused by such disclosure.
5. Refunds and Cancellations
1. Refunds are issued only as per the respective Partner’s cancellation policy.
2. Refunds will be processed to the original payment method unless it has expired. Alternate details may be requested for lawful refund processing.
3. International refund transactions may attract currency conversion or transfer charges.
4. Except as permitted under the Partner’s cancellation policy or due to genuine payment errors, all fees are non-refundable.
6. Website Content
All content on the Platform (text, design, graphics, logos, media, software, etc.) is protected by intellectual property laws and owned by the Company or its licensors.
Users may not:
• Copy, reproduce, modify, republish, distribute, or create derivative works
• Remove copyright notices
• Use automated tools to scrape or access content
• Use or reproduce the Company’s Content without written permission

The Company respects third-party IP rights. Infringement claims must be reported via email with full documentation.
7. User-Generated Content
1. Users may post reviews/testimonials after completing an Experience. Testimonials must be truthful and non-abusive.
2. Users are responsible for any content they upload. The Company may remove content violating the Terms.
3. By posting content, Users grant the Company a worldwide, royalty-free license to use, display, reproduce, and distribute such content in any form.
4. Any opinions posted by Partners, Users, or contributors do not reflect the views of the Company.
8. User Restrictions
Users must not:
• Reverse engineer or disrupt the Platform
• Use the Platform for unlawful, fraudulent, or commercial purposes
• Upload harmful, offensive, or misleading content
• Impersonate others
• Introduce viruses or malicious code
• Interfere with Platform operation or network infrastructure
The Company may restrict or terminate access for any violation.
9. Information Gathering and Use
User information submitted on the Platform is stored securely and used in accordance with the Digitory Privacy Policy. The Company may send updates, notifications, or promotional communication unless Users opt out.
10. Third-Party Links
The Platform may contain external links. The Company is not responsible for the content, accuracy, or data handling practices of third-party websites.
11. Warranties and Disclaimers
• The Platform is provided “as is” without any warranties.
• The Company is a technology intermediary, not a provider of Experiences.
• All Experience fulfilment, compliance, safety, and service delivery responsibilities lie solely with the Partner.
• The Company does not guarantee uninterrupted access, accuracy of listings, or risk-free Experiences.
• Users assume all risks associated with booking and participating in Experiences.
• The Company is not liable for viruses, data breaches, or technical issues beyond reasonable control.
For Partner-related issues, Users may contact support@digitory.com, and the Company will make reasonable efforts to assist.
12. Communications
By accessing the Platform, Users consent to receive transactional communications (email/SMS/WhatsApp). Promotional communication may be opted out at any time.
13. Limitation of Liability
The Company is not liable for:
• Lost profits
• Indirect, incidental, or consequential damages
• Issues arising from third-party service providers
• Booking disputes between Users and Partners
• Inaccurate listings or User-generated content
Your sole remedy for dissatisfaction with the Platform is to discontinue use.
14. Termination
The Company may suspend or terminate access for breach of Terms or fraudulent activity. In case of force majeure or operational constraints, the Company may also terminate Bookings, providing applicable prorated refunds.
15. Indemnification
Users agree to indemnify and hold harmless the Company, its officers, directors, employees, and partners from any claims or losses arising from breach of these Terms.
16. Force Majeure
The Company is not liable for delays due to circumstances beyond reasonable control, including natural disasters, war, pandemics, government actions, network failures, or acts of God.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of India, and courts at Bengaluru, Karnataka (or city of your preference) shall have exclusive jurisdiction.
18. Entire Agreement & Severability
These Terms, along with the Privacy Policy, constitute the complete agreement. Invalid provisions do not affect the rest of the Terms. The Company may assign its rights; Users may not.
19. Feedback
The Company may contact Users for feedback to improve the Platform. Users may opt out by emailing support@digitory.com.
